Ecdesign Cloud End User License Agreement (EULA) 2025

1. Definitions

a. Software
Refers to the ECDESIGN software and all related services, including ECDESIGN Cloud.

b. ECDESIGN Cloud
Refers to the cloud-based platform for backup, data storage, and license management associated with ECDESIGN 5.

c. License Duration
Use of ECDESIGN Cloud requires an active subscription to ECDESIGN. Subscriptions are offered on a monthly or annual basis.

d. Third-Party Providers
ECDESIGN Cloud may utilize third-party infrastructure services (e.g., AWS, Azure) for hosting and data storage.

2. License Acceptance

By installing, using, or accessing ECDESIGN or ECDESIGN Cloud, you accept and agree to be bound by the terms of this agreement. If you do not accept these terms, do not install or use the software or cloud services.

3. Service Availability

a. Uptime Goal
ECDESIGN Sweden AB targets 99.5% uptime but does not guarantee uninterrupted service.

b. Maintenance
Scheduled maintenance may result in temporary unavailability. Advance notice will be provided when feasible.

c. “As-Is” Service
ECDESIGN Cloud is provided “as-is” with no warranties of performance or availability.

4. Data Collection & Backup

a. Automatic Backup
When ECDESIGN Cloud is activated, design files may be automatically uploaded and stored securely in the cloud. Data transfer is encrypted using industry-standard protocols (e.g., TLS 1.2 or higher).

b. Design Data Ownership
You retain ownership of your designs. By using ECDESIGN Cloud, you grant ECDESIGN Sweden AB a non-exclusive, royalty-free license to use, analyze, and process your design data strictly for the purposes outlined in this Agreement.

c. Data Types Collected
ECDESIGN Cloud may collect the following categories of data:

  • License & Identity: License key, account ID, email, IP address, device ID, login times

  • System Information: OS, hardware specs, graphics card, performance logs, crash/error data

  • Usage Behavior: Feature usage, click paths, UI interactions, update activity

  • Design Data: 2D/3D plans, object placements, render settings, imported media, timestamps

Some data may be collected even if files are not saved to the cloud.

d. Data Use Purposes
Collected data may be used to:

  • Improve software performance, support, and AI-powered tools

  • Enforce license compliance

  • Analyze usage patterns

  • Train machine learning models (using anonymized/aggregated data)

  • Resolve technical issues

e. Privacy & Security

  • Design data is never sold or shared with third parties for advertising.

  • Data access is restricted to authorized personnel.

  • Design files are not accessed manually unless explicit permission is granted (e.g., for support).

  • When applicable, data is anonymized or aggregated for analysis.

5. Data Retention, Portability & Deletion

a. Retention Policy
Inactive accounts will be reviewed after 12 months. If no user activity occurs, data may be deleted after a 30-day notice.

b. User Requests
You may request:

  • Deletion of your data

  • A machine-readable export of your design files

  • Correction of stored data

Requests must be sent to info@ecdesign.se and will be fulfilled within 30 days, subject to legal constraints.

6. User Responsibilities

  • Ensure successful uploads and cloud connectivity.

  • Maintain independent backups of critical design files.

  • Do not rely exclusively on ECDESIGN Cloud for project preservation.

7. Third-Party Providers & Compliance

ECDESIGN Cloud may rely on GDPR-compliant third-party cloud infrastructure. These providers are contractually bound to process your data solely on behalf of ECDESIGN Sweden AB.

8. Limitation of Liability

a. No Indirect Liability
ECDESIGN Sweden AB is not liable for indirect, incidental, or consequential damages, including loss of data or business interruption.

b. Free Service Limitation
As ECDESIGN Cloud may be included as a free feature, no financial liability is assumed beyond that required by law.

9. Termination

a. By the User
You may terminate your use of ECDESIGN Cloud at any time. All data will be deleted within 30 days unless legal retention is required.

b. By ECDESIGN Sweden AB
Access may be revoked upon violation of this Agreement. All stored data will be handled as per the Retention Policy.

10. Export Compliance

You agree to comply with all applicable export control laws and regulations when using ECDESIGN Cloud.

11. Force Majeure

ECDESIGN Sweden AB shall not be held liable for service failures due to events beyond its control, including:

  • Natural disasters

  • Cyberattacks

  • Government restrictions

  • Network or power outages

  • Pandemics

12. Dispute Resolution & Governing Law

a. Governing Law
This Agreement is governed by Swedish law.

b. Jurisdiction
Disputes will be handled in the courts of Sweden or via binding arbitration through the Stockholm Chamber of Commerce (SCC), conducted in Örebro and in Swedish.

c. International Users
ECDESIGN Sweden AB reserves the right to enforce its rights in the user's local jurisdiction.

13. Changes to Agreement

ECDESIGN Sweden AB may revise this EULA at any time. Changes will be announced prior to enforcement. Continued use implies acceptance of the revised terms.

14. Entire Agreement & Severability

This EULA constitutes the entire agreement between the user and ECDESIGN Sweden AB. If any section is found unenforceable, the remainder shall remain valid.
